Should a window installer be expected to cut existing aperture to fit window

Recently had 2 UPVC windows installed and both have been mis fitted but are 'FENSA approved (have an independent report to back it up and have quickly learnt that FENSA are no authority on quality). One sticks out from internal wall. Installer saying it's my fault for having crooked walls and I'm saying they should have picked it up in the pre survey and/or overcome it during the installation. Basically they need to refitted and the apertures slightly cut to fit correctly. Installer saying I need to employ a builder to do it. If I had known that from the beginning, I would never have agreed and ordered a different product as I no issues with the previous wooden sash windows. The installers attitude doesn't seem right here. Who is in the right?

Whoever measured the windows should have pointed it out as it should have been at this point so if it was the window fitter he should have notified you of any buildings work so if he is unable to do the work he should cough up and then re fit the windows

Sounds like utter nonsense, of course they should fit properly. They just don’t want to as it will cost them money sending someone to rectify the problem. I have fitted thousands of windows and have never had to cut the opening unless the window was measured wrong . Fensa are useless total waste of time and just a money making scheme.

Fensa are only interested that windows meet the government requirements, they are not interested on the cosmetic look of the windows. Any decent window fitter would of spotted the promlem before they took them out.

It really does depend on the situation. When the old windows are crittels, they are only 35mm deep so part of the job is chopping back the plaster reveals and creasing tiles/window board. Some houses do have 70mm timber frames that finish flush or even proud of the building. In that situation it's OK to fit the windows the same way (though it makes sealing more awkward) Fensa is just another money making exercise for politician's friends. They have no interest in quality.
