Internal kitchen ventilation in Scotland, a landlord query

I have an internal kitchen, which has mechanical ventilation extracting via the roof of a top floor tenement flat, I am the landlord. The gas regulations mention that if no windows available, alternative ventilation is acceptable if complies with building regulations. A number of gas engineers have been reluctant to certify with a landlord certificate, as their guidance defers them to building regulations. Apparently this is a recent change to the gas regulations. How can I proceed here?

It depends on whether there is a gas appliance in the kitchen the regs do state that an openable window is needed for a gas kitchen appliance

That would be depend on appliances you would use which is most likely A cooker, so please check MI for ventilation requirements. But in general regulation requires openable doors/windows plus 100cm2 if room v <5cm2 if v 5-10 is 50cm2 if 20cm2 Is Nil
