Carport on adjoining driveway

Anonymous user 16/03/2024 - 2.51 PM

My neighbour is planning to erect a storage building on an adjoining driveway. Can someone advise on how near to my driveway this can be erected & any gaps that need to be left. Thank you in advance.

Are you a tradesperson and able to answer this question?

As long as the car port doesn't go over your boundary then they are ok

To the best of my knowledge as long as structure does not over hang your boundary line it’s fine! I would say has to be 100 mm of your boundary to allow for guttering etc? Bottom line is as long as it remains entirely on neighbours property it will be allowed ( assuming it’s a car port etc? Hope this helps

I'm not a legal expert, but I can provide you with some general advice on property boundaries and construction. However, it's important to consult with local zoning laws, building codes, and possibly a legal professional to get specific information for your situation. Here are some general considerations: Check property boundaries: Determine the exact location of your property boundaries. You can refer to your property's survey or land documents to identify the boundaries accurately. This will help you understand your rights and the limitations of your neighbor's construction plans. Review local regulations: Research local zoning laws and building codes in your area. These regulations typically define setback requirements, which specify how far structures must be located from property lines and neighboring driveways. Setbacks can vary, so it's important to check the specific rules in your jurisdiction. Consider easements: Easements are legal rights that allow others to use or access certain portions of your property. It's possible that an existing easement may affect the location or placement of structures near your driveway. Check your property documents or consult a legal professional to determine if any easements apply. Communicate with your neighbor: Open communication with your neighbor is crucial. Share your concerns and discuss the planned construction project with them. Express any specific issues related to the proximity of the storage building to your driveway. They may be willing to accommodate your concerns or adjust their plans accordingly. Seek legal advice if necessary: If you believe your neighbor's construction plans violate local regulations or encroach upon your property rights, it may be appropriate to consult with a lawyer who specializes in real estate or property law. They can provide advice tailored to your specific situation and help you understand your rights and options. Remember, the information provided here is general guidance and not a substitute for professional legal advice.
