Natural ground floor and fencing related questions

Hi, I have a question related to fence heights between two properties. First of all, a schema which will help explain the problem: https://ibb.co/KN5YFDQ Our neighbour would like to raise their fence (in blue on the schema), and I would need some advice on the legal aspect of that change. Indeed, as their terrace floor is raised (the natural ground floor is much lower), their fence will be very high on our side (see schema below). This would impact us negatively in terms of sunlight in the winter. So my two questions would be the following: • Could you please confirm that the height of the fence is supposed to be calculated between the natural ground flour (level A or B on the schema) and the top of the fence, and not starting from level C in that case (because of the raised terrace)? • In addition to this, it’s my understanding that in case of different ground levels between two properties, the lowest ground level should be taken into account, is that correct? (so level B in that case, not C) Thanks a lot for your help!

If its a back garden the hight of the fence should be know more then 6ft from the highest ground point

Anything over 2m from the ground level requires planning permission.
