Can my neighbour pour concrete 12cm deep against our boundary wall

Our neighbour has planning permission for a "small" raised decking outside the extension they are building - the plans show about 1m out from building, full width of the garden. They have poured concrete up to that height for the 1m, with shuttering, then come out a further 3.5m at a height of about 120mm by pouring concrete right up against our boundary wall (we have feather edge with small wall underneath - the concrete is almost to the top of the wall). Can they do that?

Hi, the short answer is “yes, subject to serving a valid notice and following the processes set out in The Party Wall Act.
Boundary walls are referred to in the Act as “Party Fence Walls”. The definition set out for a party fence wall is:
“a wall (not being part of a building) which stands on lands of different owners and is used or constructed to be used for separating such adjoining lands”
The party wall act only applies to “structures” (ie: a wall with a foundation), it does not apply to timber fences or other screens.
