Bathroom Fitting

No toilet for 4 weeks. Builder wants more money.

Anonymous user 23/02/2024 - 3.46 PM

Update: Well things soon went from problematic to horrendous. The builder is now being personal in his letters and is downright lying about what has transpired. I will have to get a solictor involved. Does anyone know how I can find an independent person to write a report about the quality of the work? I have had another builder saying it needs to be started from scratch but he will not write a report on this. Original Post: This is a long one but to summarise. Asked a builder to sort out a soil pipe in bathroom. Leads to the need for a new floor, re-tile all walls, change fittings, etc. Only a basic contract that he wrote. No details as such but as I knew him and it was a good price, I agreed. Changes were needed as things progressed. Some were discussed and additional materials paid for, others were not detailed and no additional labour was agreed. I paid for 25% of the total direct to suppliers, e.g. tiles, taps, toilet, sink, etc. I paid him money for materials/labour as the job progressed, approx 65% of total leaving 10% to pay. He agreed this week that there was £410 outstanding which was in line with original estimate and alterations. I said I would pay it on completion. Today he said he wanted a lot more money. I don't have it. An argument ensued. I asked him to at least fit the toilet and then we could discuss the costs. He said no and he left. We now have no fitted toilet (not had this for almost 4 weeks now), no sink, our old bath not fitted, tiling, piping, fixtures, etc only 90% completed, a hole outside the house and rubble. My disabled toilet is scared to have him back in the house. We are all totally fed up using a bucket and not being able to shower. I feel he will take me to court for money but the standard of work is poor. I am writing a timeline and aim to send a letter to him but is there anything we can do? I need the work finishing and don't have enough money to get someone else.

Are you a tradesperson and able to answer this question?

Hi, unfortunately it's never nice to be in this position; as things have got to the "argument stage", I'd suggest you write a clear and detailed letter (from the time of your inital meeting until now) including as much reference to evidence (e.g. text/WhatsApp and dates" explaining your point of view; get another unrelated party to check it and conclude with what you want or how you would want to proceed going forward -as long as its both polite yet direct you should be able to start amicable conversation. If you give your tradesman a chance (written) to rectify his work any potential for a court case judgment against yourself wil be minimised/no existent Further suggestion if you exchange money in the presence of another individual as witness (even if its a bank transfer). Be very clear what you'd want in return All the best.

I would recommend you start a claim against him in the small claims court. You can do it online and its quite easy. Send him a formal letter first informing him that you want a full refund with 14 days. Then follow up with a formal claim. I have done this on several occasions. All but one were settled by the other party. The one that wasn't got to pretrial and the judge warned the defendant this if he has done substandard, which was really obvious he would instantly lose the case. Following that the idiot settled lol. Dont waste time with other builders opinions on the work at this stage

Hi there sorry to read what is happen to you , on your matter the only solution is to go in curt with him , and don't try to communicate with him any more because the situation can go wrong . So my advice search for a plumber to solve the wc problem and in the time search a attorny or a solicitor to make a curt complain only that way u can recover your money and finish the project .
