Job not completed yet demanding payment

Hi, So received a quote for our guttering and downpipe to be replaced. As we gathered a few more quotes one of the tradespeople messaged and knocked down the price of the original quote. We ended up going with them. They've come out and replaced the guttering yet haven't done the downpipe even through the new guttering is round and the downpipe is square. On questioning this they said oh the reduced price was for just the guttering (reduced by £50). They also didn't replace the neighboring join and filled it with silicone so it looks messy. I've had nothing but threats from them saying they're going to come and rip it down but I have messages stating this was the work to be done for the price and no where did they mention the cheaper price was just for guttering. I believe the person thought he was speaking to my male partner because when I said if you keep threatening to turn up at my house I'll call the police (9 months pregnant and home alone) he said to keep the guttering? I'm not really sure where to go from here, I would've obviously preferred to have the work completed and pay them but now I need to get another roofer out to fix it all anyway?

If the Job has not been completed then do not pay them. Have you checked their terms of business at all if they have any?? If their terms of business states that all materials belong to them until paid in full then you don't have a chance but if it does not then they are not permitted to remove the materials surely! I would highly recommend seeking some advice on this. The threats are completely unprofessional and not acceptable. I hope you manage to get some answers.

If they haven't completed the work then you shouldn't pay them. I already know exactly what is going to happen…. Soon as you hand over the money you will no longer see them again. Firstly I'm really sorry this woman is going through this, that is why is tradesmen get bad names and why half the customers are untrusting. This woman should just keep the guttering as they offered her to keep it, or have it taken down to give back to them at any trouble then get someone else to come put in the rest or replace all. Keep the evidence of the agreement and that she could keep the guttering Then maybe even call the police to have it on record for her own safety as who knows what they could do as they have threatened before. report them to trading standards at your local council, you should always get a written quote for what is to be done at what price that way there is no misunderstandings, if the tradesman deviate from what is quoted do not settle the bill until you are happy, you dont have to be a rocket scientist to realize round guttering will not fit square down pipes, I would let them know your not happy with there attitude and you will now be instructing someone else to complete your job, personally IF IT WAS ME I WOULD TAKE THEIR GUTTERING DOWN AND PUT ON MY DRIVE GIVING THEM 3 DAYS TO PICK IT UP OR ELSE IT WILL BE BINNED, the fact they were so desperate for the job speaks volumes. good luck Alex

You should make them a reasonable offer for the work they've done, IMO. They don't deserve it, but that puts you on the best possible footing, legally. The correct price for a half-done bodge job isn't very high, but ought to cover the cost of the materials at least (as long as they haven't wasted them). It would be a criminal offence for them to come and remove the guttering. Calling the police if they threaten it again seems justified.
