Contractor gone bust having been paid in full, if I take him to court and win but he is unable to pay what happens?

Depends if he is a ltd company & there are any assets, you really need legal advice on your best options, this is why you should never pay the final bill till. the job is completed & everyone is happy.

Small claims is the best way but even then they can offer to pay very small amount at a time back

If the person can't pay you lose all, including the court fee. If the individual, or the business, owns nothing the bailiff have nothing to size. I would do some research on the person before doing anything, but a pre-proceeding letter, which is due anyway before starting any court proceeding, could scare them in paying back the owed money. So it may be worth trying to send it. Unfortunately, too many people have no idea of how a court claim may affect their life for a very long time and feel safe since they own nothing and just ignore it. They will likely regret it in the future but that's of very little help.
