Neighbour wants me to pay for fence on their land

Anonymous user 23/02/2024 - 3.45 PM

Hi, The original boundary fence between mine and my neighbours back garden was 3ft high. They then erected a 6ft fence on their land (never said they were going to), well inside the boundary, which blocked out sunlight to my conservatory The house was then sold and the new neighbours are now asking me to contribute to costs of repairing the 6ft high fence which sits on their land, which was damaged during storms. I have said no, as it does not sit on the boundary and is completely their fence and responsibility (explained what previous owner did and showed them where the boundary is / original concrete posts still in tact ffom when house was built and still have original plans showing boundary but 3ft fence panels have blown down too) Am I right saying I am not responsible for the 6ft fence inside the boundary line on their land, as I feel I am ?

Are you a tradesperson and able to answer this question?

If it’s not on the boundary, your not responsible for any part of it.

Yes, you are correct in saying no. You are definitely not responsible for a secondary fence on your neighbors land. Maybe negotiate on restoring a fence on the boundary line, pointing out they would then recover 3 foot more land along the boundary line.
