Right of way purpose/ Access
Anonymous user 09/03/2024 - 3.26 PM
Hi I live in end terraced property and property is next to right of way that goes through side of the property and to back of the three properties on Right. I have checked title deeds and all 3 houses have benefit of right of way. However in title deeds it doesn't specify the limits/use/purposes for right of way. Is there anyway to find out what right of way access could be used for ? Thanks

If there is a right of way, or the people who use the route have had uninterrupted use for 20 years or more then it is unusual that any specific limitations are in place. Contact your council or ask a solicitor to carry out a search.

The purpose of the 'right of way' is to maintain an access route to all who need it - in your case all houses with direct access. Therefore there are obvious 'assumed' limitations - that the route must be kept clear, not built over, kept safe for all users - and anything avoided that would impede the ease of use by all those entitled.
However - if you need more specific confirmation then I would ask a solicitor or the local council

You really need to speak to a solicitor. I don't know what your deeds say and which of the home nations you are in - land law varies - and that will have an effect on what you and your neighbours can do. Typically every property owner would have the right of beneficial and reasonable access but unless it's detailed it's far from clear what that actually means.
