Loft Conversion

Roof leaking (JCT contract gurantee & legals)

We had a builder do a loft conversion and extension on our property 10 months ago. We paid a full and final payment 3 months after completion. Both roofs are leaking and require circa 4-5k of work (absolute botch job). We have WhatsApps from the builder stating they gurantee work for 10 years but he is basically saying not his problem and he won't fix it/pay for fixes. He is almost goarding in his response so I am wishing to legally pursue in small claims court. The work was done under a JCT 2016 contract and I am wondering whether a gurantee provision is part of that contract template ?

Hi, I appreciate the worry this must be causing, but this is really a legal question for a Solicitor or Citizen advice. The trade experts on this site could only really comment against the quality of the repair, work, fitting etc. I would not advise taking opinions from a trade site on this kind of issue.

Under the JCT contract a builder/designer is typically liable for 6 years after completion assuming the contract is signed "underhand". In this scenario you should contact the party who acted as contract administrator, presumably the Architect, and find out the reason why this defect has occured. It is probable it is a workmanship issue, a design issue or simply a faulty product. Once the source of the issue is determined you can pursue damages in line with the terms of the JCT contract you signed.

Hello, it is not binding on the contractor if another work is done by the Landlord, other than the contractor or his staff, and the roof is damaged. Otherwise, the contractor has to fix the problem. The customer can use his legal rights.
