Fence on neighbours ground but expect half paid

My neighbour wanted to put up a fence as selling there home. They said the cost split and old council type wire fence removed. Agreed to that snd Also talk to the joiner about how it’s going to look. They have now said they won’t be removing old wire fence joiner hasn’t talked to me. There is a wire fence then a small wall as houses built on a hill. Since I work nights I woke to find it built, the fence slats facing them has been built about 1ft away from the original boundaries fence on there side of the small wall My worry is the fence on there land if I were to paint etc there’s a high risk new neighbour may say I have damaged the fence and within rights press charges. Am I still liable to pay it now?

no it is on their property they have to pay not you.

Since the fence is on their property you should not have to pay any costs involved.

As they haven't replaced the original boundary fence as you say was discussed, then have instead built a new fence 1ft inside the wire fence on their side they've removed the possibility of it being a shared boundary fence. Therefore negating the reasoning for you to pay half or anything towards the costs.
