Who is responsible for damaged tiles once they have been laid?

I got a tiler in to tile a fireplace hearth (approx 1m2) that was for be flush with the floor. He visited my house twice before the job and advised me to dig out the hearth and fill with concrete, which I done, to apparently save me money. After doing this, he still wanted £265 to do the job. I picked up the tiles which were unopened in the box and cost £120 (not cheap!), and I came back from work to see that 18 of the mosaic tiles he had stuck down were chipped/missing a corner. There was also 2cm gaps either side of the hearth edge which were filled with splodges of tile adhesive. He also called to ask if I would go round to the house to clean them that night as he couldn't get the black grout off the white tiles and he didn't want to come back to do it that night. He said that the tiles were not his responsibility as they were supplied like that, and that he couldn't see the chips until they were grouted. He also said that the gaps were my problem as I didn't measure to make sure the tiles would fit in the hearth area. After 2 weeks he came back to fix just one tile, and in the process left notches in the tile next to it. Who is responsible for this? Because at the moment it seems to be me who is getting the blame (the reason I got a 'pro' tiler in to do it in the first place!).

Hi It sounds like the tiler hasn’t very much experience . Firstly the chipped tiles should not have been layed if they are damaged,any decent tiler would notice this before laying them. I would ask him to come bk and re do the Job to your satisfaction,or ask for your money bk to find a professional tiler

Hi Why would a tiler fit damaged tiles? I can't get my head around that! He should of called you and explained to you the issue and you could of worked out a solution to the problem there and then. Instead he ignored the fact that the tiles were damaged and fitted them anyway causing this predicament. I wouldn't pay him until he comes back to rectify the problem, if you have paid him already I would ask for your money back and hire somebody else.

Hi any Experience professional with an eye for detail would’ve inspected the materials before use ……as a rule I would always check the product prior to starting any work and if there are any problems get the client to amend them it sounds to me that he’s a DIY A and not a true professional it’s always good to check out on previous jobs and to speak to previous clients apart from my Gallery on mybuilder I always show a variation of work completed by myself to show clients when I’m surveying or pricing any work I hope you haven’t paid him !? If you Have asked for your money back Also asked for compensation for the product that was installed that was faulty that could’ve been returned which is now probably impossible saddens to me to see such a easy job turned into a nightmare for someone like yourself which would naturally in future lose trust in professional tradesmen making our job a lot harder I wish you all the best

As the above, get him back to do the works to your satisfaction, why would he put damaged tiles down is unbelievable, this is something that you will look at forever. And tell him to pay for everything.
