Taking a fence down between two back gardens and leaving it open for many weeks.

My neighbour is going to take down the fence between our property's and going to leave it down for a long time. When he put this fence up many years ago he put it on my land and refused to move it back on to his land. He also has dog that would be able to come into my garden if there was nothing stopping it. Removing this fence would leaves my property open to anyone which means they can get into my property and out buildings. I also have young children and leaving this area open would be dangerous to the children not only because of the dog but he also has a hot tub and high steps down from his garden to his house which the children could fall down. Can he do this without putting something up to stop his dog and the danger to the chidren.

it might be worth while talking to your local council & your local health & safety officer, its not ideal but it his fence so this may just be a way at getting back at you, call me stubborn but if it was me a would just go and put my own fence up making sure it was just on my property line.

Hi Jason jje builders here.... Firstly weather its right or wrong to leave the boundary fence down or not you will need to seek legal advise with the boundary line. This can be done via a phone call and them visiting you and staking out thr boundary for you. It will stand up in court and it cant be contested by your neighbour!. As for the fence being down for s long period of time that's not good. You should talk to your neighbour forst and explain your points first. If he has no good reason for leaving the boundary open for more than a few days then I would call legal advice team online. And also if this is a danger to your family or property then speak with your local mp. They know all the right doors to open and this might be a huge help. No one wants to fall out with neighbours but it is what it is unfortunately. Legal advise will help you and give you a better chance of resolving this issue.

I don't believe it's a legal requirement for a boundary to be enforced as long as it's listed on plans, I think the best course of action would be to install your own one on your side so nothing can be disputed & no danger can occur

Well, if it’s on your land seek legal advice as if he goes on your property and the fence is on your property he is trespassing if he goes on your land. This should have really been sorted out before when he put the fence up. He sort of takes or infers that because you swallowed it last time you will put up with anything. Try and prove him wrong.
