adjacent to highway

we are in the process of purchasing a house at the moment. the back garden is fenced with standard 6 foot fencing apart from a strip of grass that belongs to the property which is on the other side of the fence (not enclosed). This strip of grass (approx 3 metres wide and 25 metres long) is next to a pavement and currently has 1 metre chainlink fence around it. would we be able to replace the 1 metre fence with standard 2 metre fence as it is "adjacent" to a highway as it would be our back garden?

The answer is probably not. However i would always contact the highways dept at your council as well as the planning dept. A costly exercise if erected without consent. Some councils have different rulings to others and they look at each case individually.

I agree with what the other tradesman has offered in their answer, I would check the house deeds first, if this allows you to carry out the works, if there is nothing in the deeds then I would contact your local authority, permissible heights are 2m max side and rear fences and 1m to the front, if it states you can in the deeds the local authority cannot compel you to remove the structure. I would look at the deeds to the house in honesty ,if the patch belongs to your property and is listed in the deeds as a boundary you should be ok to do it ,if it's not I would look into it further .
