substandard and unsafe works

Anonymous user 16/03/2024 - 2.43 PM

my landscaper has carried out substandard work and my garden is now unsafe. can I claim my costs back? my garden wall and gate were installed incorrectly and now there is movement in the wall because I discovered it has not been tied in properly and the timber post holding my gate is not straight. I was told the wrong bricks were used also. my nearside patio is uneven and the drain beneath my kitchen window has a cracked gully and it is not connected to my main drains. this all means that there is a probable risk that water will be channelled towards my home and cause further water damage and mould. A soak away system was installed under my lawn but have later discovered this was filled in incorrectly only with old crazy paving and soil. The ACCO drains job as I understand is to channel water away from my home into a void under my lawn which was not created. my lawn is now bumpy and sagging with the likelihood of it becoming very muddy and boggy. it has cost me around £7000 and I am unhappy and need advice please of who to approach and how I could possibly get the work rectified to a high standard. I need to get my money back somehow. his work was such poor quality that I do not trust him to come back and rectify his work. I would be very grateful for any advice and help of how to recoup my losses!

If the contractor refuses to put the matter at hand right you can claim your money back via a civil matters case in the court

It would be very difficult to comment on this post unless I have seen the defaults for myself but the threat of a small claims court procedure to the contractor might help them rectify it

This matter can be resolved in a civil rights court. You should seek advice from the Citizen's Advice Bureau immediately. Unfortunately, the problem may be more immediate as there is a likelihood of water damage and there is always a risk of stormy weather in the UK, so this could cause poor fencing structures to fall and cause even more damage. Serious professional advice should be sought, ask for a couple of quotes to try and find a balanced opinion.

If the works were completed incorrectly and breaking contract/scope of works then you can quickly file and start proceedings through small claims court (as under 10k). You’ll have to gather quotes to rectify the works. The contractor will either dispute, agree a settlement or go along with any claims. Generally not a quick process 6-9 months depending.
