can my neighbour sue me as they say my dormer will stop them putting a dormer on their house.

Hi We put a dormer on our house under permitted development, the neighbours were up in arms. We have had court papers as they say we have devalued their home by £20000 as they will not be able to do the same due to our ridge steel resting across the whole of the Party Wall. Has anyone heard of this happening before and what was the outcome? Any advise would be appreciated.

They would have to prove this is the case to start of with. If planning permission etc was necessary the residents around your area would be notified and the council would have looked at your property for building regs.

The nabour would of need to sign a party wall agreement prior to the build so they would have be aware work. However the steel should only be bearing on half the thickness of the party wall. This should be easy to rectify by consulting a structure engineer and cut the steel back. I would expect the builder to do this as it would be consider their mistake.

Hi you are not aloud to run a steel across the whole of the wall. You are meant to lay the steel in the middle of the wall. Now because your steel is covering all of the wall , your neighbour can not fit his steel because he has nothing to lay it on. He can still build a loft , but they will have to reposition the steels. It is against regulations to enter your next door neighbours loft with steels . Your neighbour has a case , so I hope your builder has insurance . Hope that will help.

Your ridge steel should only rest on your side of the party wall not on their side. If the steel has been incorrectly installed they can still put a ridge steel on their side and support it with a timber or steel post or cut the steel back so it only rests on your side of the party wall. You haven’t devalued their house at all and the court if needed will side with you.
