Can neighbours refuse to let us maintain our fence

I have just found out that the boundary fence between my and ourselves is ours - previously told it was theirs ( found Tmarks on boundary plan) . Our neighbour has said if it’s not hers she will not maintain it. It’s a wooden paling fence with palings on her side . If we need to maintain it we will need to go onto her property to do so - with permission of course . If she refuses can we remove palings from her side to ours in order to maintain it

If your neighbours agree it’s not there’s you have all rights to do what u want with it and of course would need to get permission to go in her garden

If it your fencing you can take it down and replace it or turn the panel's around to maintain it you can do this from your side and do not have to go in your neighbour's garden

Yes - you are legally obliged to maintain your property by access from a neighbours property - if you’ve asked for permission and they are refusing you may need to seek legal advice before proceeding though, as the neighbour will need written notice etc
