Neighbours fence but attached to our post

Anonymous user 09/03/2024 - 3.22 PM

So my neighbour thought the right side fence if us was ours as our previous neighbour put it up albeit incorrectly and he attached it to our post. She knows it's hers now after showing her the deeds but the fencers have followed the line and attached the last fence to our post you can see the line isn't straight I told them before it was erected the angle was vering and shouldnt it be attached to her end garden post not ours. They say they have to follow what was there before legally is this correct even if it was wrong?

Are you a tradesperson and able to answer this question?

if you want it corrected your have to seek legal advise. you have the paperwork to prove this. a building surveyor can confirm this for (boundary dispute surveys) they can legally settle this dispute for you... jje builders

What the fencing company said is in correct Most detail boundaries are in a straight line regarding fencing lines as this would show on any legal binding deeds They should of put a post right next to the existing fence to reinstate the boundary

The question to ask is: "was the previous fence erected on the correct line?" The new fence should follow the line as shown on the deed plan and a new post erected to suit. Attaching posts or fences to other fences that belong to neighbour's, should only take place if mutually agreeable.
