Advice welcome please, do I have to put in new planning application?

Our original builder over built our extension by 37cm in width across the front. The 37cm is in the middle of my property affecting no one. My neighbour who has made the build extremely difficult for all involved has complained to the council. The council have said that we need to put a new planning application in. I cant believe that we cant do a NMA as shall built and roof on. I dont want the hassle of dealing with the neighbours objections again. Any advice welcome... Would the council take us to court over 37cm in width in the middle of my property that affects no one other than us? Thanks

In im opinion. And with only the small amount off information given. The council may ask you for new plans as 370mm over what distance can be seen as increased footprint to what was agreed by all parties. Eg a 4 x4 m extension by increasing because the customer wanted that as internal not external now makes it 4.300x4x300 . There for not so minor change and wouldn't be seen as an nma.

I’d adhere to what the council are asking if you, but I’d insist the builder cover all costs involved as it’s his mistake for making it too big. Especially if you had architectural plans with dimensions to work from. No reason unless you asked him to.
