Am I in a position to claim money back?

Anonymous user 09/03/2024 - 3.21 PM

So I have obviously done my research too late and fell prey to a company, who have been featured on Rogue Traders show cheating people for 'repairs'. and charging exorbitant prices. We had to diagnose why our Central Heating system/Hot water wasn't working properly and obviously looked up a local gas engineer. What we thought was that they were local, but it turns out, this company registers multiple website domains masquerading as a local firm. They charged me £174.00 directly out of my account without my approval (they needed card details before sending an engineer) for an engineer that pretty much did nothing, spent maybe 10 minutes flashing his phone torchlight around, and claimed my pump was faulty without running any tests, which according to them; was a quote of £1550 with VAT to replace. I later find out after booking an actual local company that the pump was perfectly fine, and have a written report from the 2nd engineer that it was simply a faulty motorized valve. Its been a constant back and forth and for over 3 weeks now, they have kept saying "we are still waiting for our engineer's technical report". Judging from reviews, they will most likely drag it on for as long as possible. Am I in a position to claim my money back? Small claims court?

the fact you gave your card details out indicates a contract as such, which you would need prove you did not agree to , all they need to say is you agreed to the charge and gave your card details as payment, you need a solicetor to advise if you have a case you can win
