can i get my refund on my deposit

i was wondering can i get a refund on a deposit on a job for an extention. I paid 5300 deposit for the builder to start work and for materials on site. because he started the foundation and found no clay he recommended it needs piles due to they dug too deep. the quote they gave me was too expensive, so i found another quote myself. He say 2500 has been spent on just digging the trench but there was no materials on site. The deposit was for site survey and materials on site. Now the work has stopped due to we dont trust the middle man due to keeps asking for extra money coz the job was done through an architech company. He says there is still money left over and he could deduct the remaining money from the total cost of price. Now i want to get a different builder so is there any chance of getting the unused deposit back. Plus the sort of contract which is stages of the job, states that they are incharge of taking the soil away. now he want extraa 600 pounds to take the soil. please advise. The whole process is through the architect company

It sounds like you and your builder need to come to a mutual agreement I would always recommend a contract with as much detail as possible this protects both customer and builder in the unfortunate event of a dispute Good luck LMC BUILDING SERVICES

The builder has no control over the depth he has to dig underground , its unforeseen and its where the building inspector has control over builder he can only estimate it to about a metre deep. or what's on the drawing he's going by , what is the total depth of the dig now, maybe you can ask him what he had in for the footings , then measure what extra he has taken it and come to an agreement , or just ask the builder to carry on and complete the footing im sure itll come to more than the deposit

Good afternoon. It’s a shame you feel let down. In my believe the builder has dug down to deep. His responsibility not yours. Obviously no one can make a judgement on ground conditions below. Should no soil has not been removed and no materials not supplied. A proud builder would either negotiate or refund a least three quarters of the money.
