who pays for the replacement ? me or neighbour

My neighbour put up a fence 5 years ago, didnt ask me first, she took down what was there already (connifers) and replaced it with a fence, not being fixed into posts correctly etc, not maintained over the years, it is now rotting and has fallen the bad weather hasnt helped, i have a 7 month old dog and she is claiming he has caused the fence to become damaged, ie fall over, the wood is clearly rotten, and is in desperate need of repair or replacement, but i have been told, if she put up the fence, paid for it etc then its her fence i am not responsible is this right ? i was advised to write her a letter, she has over the past month sent me rude text messages and 3 have been threatening and demanding im really feeling depressed about the whole thing HELP !!!!!!!!!

Unless you have a 7 month rhino i dont really see how you have caused any harm to HER fence.If she took out the conifers then the fence became her problem and as such,she should sort it out.You shouldnt suffer threats either.As a builder i cant really advise on this other than to keep the texts and take the matter further ie police if they continue.Good luck with your clearly mental neighbour.

you need to look at the deeds for the land your house is on and if it says on the deeds that ownership belongs to you then you can do want you want to the fence {erect a new one} and then she could be in a spot of bother because when she erected a new fenceshe would have had to erect it on your land {only if the fence belongs to you}. thanks dan
