party wall dispute

I started a side extension where a garage was demolished and we wanted a two story extension built in its place. We started just before Covid and had problems with the water board approval. It took 3 months for the water board to approve. Work got started but was let down by builders and had to stop again. Our neighbours started getting very aggressive and sent us a letter stating that we have broken the law by not having party wall agreement. We apologised and asked a surveyor to do a party wall agreement. Before the agreement has even been drawn , the neighbour has instructed a builder to build a wall between our properties. When I asked him , he stated that he is establishing the boundary and will make us pay for it. What I notice is that the wall he is building is on my land. What do I do , what are my rights.

Hi there this is a tricky situation unless you really get on well with your neighbour your neighbour should have put it verbally and in writing and then if they don’t get a response within 14 days they then need to alter there drawings and to build there wall only on there land and upto the boundary line hope this helps a little kind regards Matt M4 construction

Write the neighbour a letter offering to meet amicably to discuss the issue and that you would like to resolve any misunderstandings. If they do not respond, your next move is to seek adjudication. Keep a record of everything and be seen to be amicable and approachable. Make sure you armed with the facts about the boundary position and any party wall agreements. No one can build anything on other peoples property but its up to you to prove it. Its a difficult situation and your best bet is to find a way to repair the relationship, humility is always the best approach. Good luck.
