Neighbours new fence has left me with a 0.5ft x 2ft deep trench on my side the length of the garden

This is probably an odd one, as most fence line changes are about encroachment - in my case my neighbours new fence has moved 6 inches into their property! The problem is that to get the new posts in, the fencers have left a trench on my side of the property. As we’re on a higher level than next door, this runs as deep as 2ft, the length of the garden. We’ve got raised beds running the length and the the rear of these sleepers are on the edge of the trench, and with the recent rains I’m concerned about them subsiding. The fencing company made no attempt to call over to discuss. Besides the trench, and the fact they were working in my garden, they also left an old panel on my side and the move has also left a dangerous gap in the side passage and a door that no longer closes properly due to the fence move. I mentioned it to my neighbour yesterday who was obviously unaware as her side looks great. She’s speaking to the company tomorrow, but where do I stand in this situation?

Hi, If the neighbour has moved the fence further into her boundary then the void left is technically still her property and technically she can leave it bare, however if her works has caused issue to your property and this work has taken place without prior notice of what was going to take place you MAY have cause for recourse, I would suggest wait and see what the firm chooses to do, It could be something as simple as backfilling the gap with top soil, They obviously should take the old panel with them. hope this helps and i wish you luck

If the fence has been moved further in to her own boundary the gap behind should be sorted by the person having fence fitted and the company fitting fence but the old fence should be taken away also if your door/gate was closing before they started work then it should work when they leave ?

Hi the fencing company should not of left it like that to be honest. As a common courtesy both client and neighbour should be in the loop as to whats going to happen. This situation that has occurred should of been picked up on the initial visit to view the job and both parties informed. Without knowing if your neighbour knew what the plan was would only be fair for them to get it rectified to make your side safe. Like the other fencer said might just be a case of getting it back filled. But I'm guessing the fencers only used one concrete gravel board if its panel fencing. So the soil would be sitting against the wooden panel if back filled. Your neighbour should really pay for them to come back and rectify it if they knew the fence line was moved. If they knew nothing the fencers should do it off their own back really. Hope you get it sorted. 👍
