Who pays for Party Wall

Our neighbours are converting their loft. We are probably doing ours next year. They say we have to pay half of their costs for building the party wall (ie 1.5 K), and that this should be a clause in the party wall agreement. Is this right?
Are you a tradesperson and able to answer this question?

You don’t have to pay anything for the party wall build up if you have NO intention of converting your loft but your neighbours will have 100% ownership of the wall, but as you have stated that you are planning to in the future then it is in your interest to pay the 50% as you will own 50% of the wall, if you choose not to then when it comes to you converting and want to attach your loft to the wall then they can still make you pay 50% of the cost as you will be using there wall for you loft conversion.

I think if your were to be awkward you would get ownership without paying, as the wall will have to built on top of an existing party wall.
If they want to build the wall they can. But, if half is on your property they have built a wall that is half yours anyway.

They should only be building on their half of the wall and should not encroach onto or over your property and therefore you shouldn’t have to pay anything towards the costs.However if you want to do yours in the future and get full use of the width of your own loft then you would have to join to there dormer so best to discuss and if you pay towards the cost then you should get a written agreement you can join onto the dormer in the future.

Hi the party wall agreement, is where the surveyor checks out the wall on your side and a separate one checks the wall on their side. This then is paid completely by the side who is doing the work. It will have to be a separate agreement when you do your work. You can save costs by getting a party wall agreement signed up for your proposed works at the same time. Although this usually involves getting structural drawings made up for your build. If your intention is not to do this yet, then they have to pay all the costs. If they don’t and you get cracking they are liable to pay for remedy work.
