Patio laid higher than dam proof course

Just had a patio laid. Around the conservatory it is higher than the damp proof course, so now only one course of the blue bricks are showing. I have been told by a surveyor that this is not correct. The guy that laid it says the regs have changed and it's ok. Who is correct

Cut paving slap 150mm away from house and 150mm below dpc fill with pea shingle job done easy

your ground level should be 150mm 6 inch in old money below your dam proof course, the surveyor is correct, the guy that laid is wrong and he knows it.
There are two problems with the above answer. As your patio layer has used the wall as a stop to prevent your patio from moving cutting the class without concreting the end to prevent movement will mean your patio will fail prematurely
Do not fill with pea shingle this will not achieve what you want use at least 20mm stones
This is really something you should not need to do if the job had been thought out properly prior to it commencing
