How much to pay and when - seems risky!!

Hi all, I have a company appointed to construct a large area of fencing and some driveway gates. The quotation was £6435 which I accepted. Materials £3755.20 Fixings £180 Labour £2500 I paid £250 to secure the start date and then the £3755.20 for the materials. On day 1 of the work, I was asked for £1000 in cash for the labour and £200 for the hire of a nail gun, which wasn't on the quote. Week 1 they did 3 days work They realised that the trellis hadn't been delivered and blamed the supplier for not including it on their quote so I paid a further £400 for that. Its not been delivered yet. Week 2 they did 2 days work. The sun was out!! I was told that the gates would be erected on Wednesday but they didnt turn up and didnt message me to let me know. Now its the end of week 2 and they turned up while I was out. Did a little work and sat in the driveway for 2 hours waiting for payment. Still no gates or trellis! They are asking for another £1000 for labour today leaving only £500 remaining. I am worried that, if they get another £1000 before the work is done, they'll do a runner on me. Am I right to be concerned. Thanks

Unless a payment plan was agreed prior to which you stated you would pay these sums at these specific times I would hold on to any more money and as stated above no more payments until the job is now completed. Materials upfront as a proforma invoice then possibly staged payments throughout to cover labour however on such a small labour cost would usually take full payment at the end. Have a chat with who ever is in charge and explain not enough work has been completed to warrant another payment out. Hope this helps.

In my opinion the remainder should be paid when the job is complete. When quoting work, we would only ask for the cost of the materials and then the remainder at completion. Also, if they usually do this type of work it's surprising that they need to hire a nail gun. Ask them to return when the gates and trellis are delivered and tell them that you'll pay when the work is completed.

We would ask for a 35% payment upon delivery of the materials then 15% after the 2nd day work. The remaining 50% at the end of the work carried out so that the customer and we are happy with the works done. Jay All works all day
