How to sort out the disagreement about the boundary for fencing?

Anonymous user 28/02/2024 - 3.52 PM

Five years ago my husband did our fence. But he used the 10cm concrete post. He put the post in the same place of old post. The previous owner didn't use a post at the beginning of the fence. He just use a wooden stick on our wall as a suporter then five centimetre wooden posts for the rest of the fences. At the end our fence was not straight because of our flowerbed . After my neighbour complain we decided to change it because of health and safety issues. If we put the concrete post i in between the two extention it goes straight other wise we have break our flowerbed which is in our garden. My neighbour say you put the fence in the same place and break your flowerbed. The space in between the two extentio is our they said to us. And she put the concrete attached to my concrete tires on my garden. No boundary left for us to replace the fence.

Are you a tradesperson and able to answer this question?

If you got in the same post hole I dont see the problem talk to your neighbour's if that does result in a problem back to beeds of the house

Check the deeds of purchase, the land registry commission will hold them and you can download them for a small charge, this will give the exact position. https://www.land-search-online.co.uk/portal/boundary-searches.asp?search=2-properties&gclid=Cj0KCQjw7Nj5BRCZARIsABwxDKK7Ew3uCbE-_n7obl_i2JiEXFd9Ai7ZbOa2PmDlX5NOpa5T1BHbV78aAk7lEALw_wcB

Oh wow, sounds like a tricky situation. Is there anyway of modifying the flower bed to accomodate? My humble advice is always, always try and discuss with neighbours first about fence lines. Its usually very straight forward providing both parties are in agreement. It all depends on what your deeds say when you bought the house as to who the rightful owner of the fence is, it will also give some broader guidance as to where the boundary line is. Someone above has posted a useful link. Prior to any fencing installation, I would suggest running a string line, there you will be able to see exactly what is/isn't over the boundary line. The string line meets at the top of the posts and hey presto! a nice straight edge for the fencing team. Good luck with a resolution and I hope it all works out well in the end! Original post holes may not have been in correct boundary. Best thing you can do is get your deeds if house owner and double check the measurements on deeds which would confirm and nullify any disputes Best to do that before it gets messy with lawyers etc
