My Boundary fence being encroached by reaction of neighbours fence
Anonymous user 16/03/2024 - 2.33 PM
Hello, I have just erected a fence which is mine. It is the slotted concrete type. My neighbour is now butting up a higher fence which the posts will touch my panels. Also think that having 2 panels together will eventually cause rot. Also the fence they are putting up is 6-6” high above my ground level. It is a good 6” above mine and cause an unsightly look stocking up above my fence.

As a general rule, fences in back gardens should not be higher than 2 metres. ... Or you can decide to exercise your rights, either way and install your own fence of the desired height (on your own property), right next to the fence, installed some time previously by your neighbour.

If his fence is on his land and it’s 6’6” above ground level then there is nothing you can do about it, he’s well within his rights

Who’s was the fence originally a general rule of thumb is the rails and posts are on the owners side while the boards or feather edge is on the neighbours. To have two fences back to back is pointless .if you can’t resolve the issue just put a trellis on top of your fence to help disguise there fence

Hi look at the party wall act.
Most property has its own boundary!
On average if you are looking out towards your garden the right hand fence is yours
Same for your neighbours so you are responsible for one normally
But depends on location. Check your deeds and contact your local council or building control at the council office

If you have installed a new fence on your boundary line and your neighbour is putting a fence next to your fence on his land and is not going over 2m in height then there is not much you can do.
Have come across this numerous times where neighbours have build another fence right next to boundary fence just to have a “nice” side facing their property.
A fence height of 6ft panels with a 6” gravel boards is perfectly acceptable height for a rear garden fence.
