Semi Detach 4m extension planning help

Hi, I am in the process of putting in a request for a 4m rear extension on a semi detach property and would like to know if my neighbours object to this would the approval be rejected or is there any other application i can make. I know 3m extension i would get without any issues as standard. The issue is the rear of the property is on a slope/drop and the garden is 1.5m below in height. Under the property is a basement 1.5m high ceiling so not really something you can use apart from getting access to the meters/boiler. On the new rear 4m extension i am planning i would therefore like to dig down in the garden so the new extension has a livable space on the lower ground floor and isn't 1.5m in height so i can have a proper room, digging down will not affect the neighbours view or sight etc. This would then make the extension a double storey i am guessing? Due it being classed as double storey is permission rejected straight away for 4m on semi detach if neighbours object. The neighbour has a 3m decking/balcony on his rear already would this affect consideration to the application? If i only submit 4m single storey extension without making the lower ground floor livable space i.e. leave it at 1.5m basement in height and then later make it a livable space by getting it dug down would i need permission for that or would that bypass the process. Any advice or suggestions as i couldn't find anything on the planning portal website etc. that fits in with my extension plans.

Good morning you can get the planning permission for Extension for 4 meters if you put your planning permission by your architect with all the details and if your neighbours are not complaining about the plan you have to have a party wall agreement with your neighbours to protect your extensions with no problems you don’t really need to dig your garden 1.5 metres because your new extension flooring is going to be same as your old floor level your new extension can go higher by low up to 2.7 -3 metres maximum from your ground to top of your extension so if your architect doing all the planning right with all the details and the neighbour is not complaining about the plan you should get the planning permission but without looking at it that could be my answer Thanks Adrian

As long as you do it to building regulations I can’t see a problem regarding planning the next door neighbours haven’t got a leg to stand on as they need a very good reason for objecting as blocking a view isn’t classed as a good enough reason I should know as my wife is on the planning committee of Worcestershire city council

Hi extending beyond the 3M and up to 6M can be considered for a semi-detached property under a " household consultation application" but this would stil include neighbour consultation / comments so objections could be raised albeit not necessarily relevant and mat not affect a decision by the Local Authority. However if your proposed works are on or adjacent to a neighbours boundary you would need to comply with both Section 2 and 6 of The Party Wall Act, namely building on party boundary or new foundations within 3M of existing foundations. This would need you to inform and to receive written your approval of proposed works from your neighbour prior to commencement. To do so without is unlawful. Regards David
