CLIENT WANTS REFUND, COMPENSATION AND FOR ME TO PAY FOR NEW PATIO

Thanks all! Can’t seem to post a reply? I said 14 days because I would be free to do the remedial work straight away as apposed to visiting and then coming back a week later which I’m sure they wouldn’t be happy with. They are being very unreasonable as they want a refund plus money for a new patio plus compensation. I’m pretty sure no judge would award that but I guess it’s just the hassle of going through the courts if their solicitor writes to demand it - nothing more I can do I guess other than wait to see what the solicitor says Hi All, long story but il try to keep it brief Laid a new smallish block paving patio 2.5 years ago for a client. Was there to do maintenance on the existing but they wanted a complete new fit They were happy with the work and paid in full. over 2 years later they called to say water is sitting in the centre and can i come out I said yes i will be back out within 14 days Next day i received pictures - cant see any dips in the patio at all but the pics were on dry surface. Looks the same as it did when i laid it. The patio is solid with no movement and they confirm this later that day 8! more emails followed, threatening legal action and they don't want me back as they don't trust the work and the water is not draining as should. Also that the work is unsightly. Its not and they have never mentioned this before now. i again said i would be happy to come and have a look and fix any problems More emails threatening legal - they want a full refund of the cost of the work, me to pay for a new patio from a company they appoint and compensation for the hassle I will be contacting a solicitor but my question is can they legally ask for a full refund, cost of a new patio and compensation? thanks for your help

Nope... legally they have got to allow you access to view and make good the problem... you’ve asked to go back and they won’t allow it!!! If you have looked at photos and it look absolutely fine, then it sounds like they are inventing a problem to try and get money back to maybe change it for something else, I can’t think of a reason why they don’t want you to call... I’ve been in the building trade 38 years and I’ve seen it all... sometimes the customer isn’t always right!!.... good luck you sound like a decent chap

If you didn't guarantee the work. After 2 years living with it .they have no right to demand it's done again at your cost.youve offered to do any adjustment.they refused .end of drama.

After over 2 years? they are in no right to ask you for any compensation. send a letter to them that if they do not stop to harass you will take legal action.

The client is being very unreasonable, if a defect appeared in your work then it’s only fair the builder return even after two years to assess if no set time was written with a guarantee , if the client suddenly refuses to let you attend the issue after you agreed to return then the client is at fault and I would expect any court to think the same , 14 days is a long time to re visit however if there is no health and safety issue or damage being caused which there dose not appear to be then I can’t see any problem , something very wrong here !
