Attaching new fencing to original fences
Anonymous user 09/03/2024 - 3.09 PM
My neighbour, has replaced the fence that’s at the rear of our garden and the rear of theirs. They did so without speaking to us, but it’s better than the old fence. However we are left with a gaping gap at the bottom which is very visible from our kitchen and the boundary line has been moved back which means the fences at the side of our property which are only a year old are not now attached and are a 15 cm gap to the new fence. Do they have to rectify this? We want the missing gravel bored put in and the fences to be attached

Hi it will depend if this back fence is your responsibility or if it’s theirs; you would have to check the house deeds to confirm which side of fencing is yours; if the back fence is yours they should have spoken to you before doing any alterations regardless of it being a better quality fence and if this is yours then by law they are required to either put back the way it was or to come with an agreement with you which in your case is to rectify it By adding the gravel board and attaching them fences; however if the back fence on the house deeds is their responsibility (their boundary fence) then by law they are on the right and are not obliged to do anything to help you and if you want to add the extra gravel board or attach them fences at the side by law you then would have to ask them permission to do so!
I hope it helps
Best Regards
Alex

Hi what they do into their garden is they’re responsibility but for no reason they can’t disturb remove or damage your fencing or your property unless they ask your permission to do so . For this situation they need to repair your fencing or compensate the damage . All the best SFS construction ltd
