Can my neighbour legally move her fence on to my boundary

Anonymous user 28/02/2024 - 3.48 PM

Thanks for your answers. To put the fence on the boundary would mean digging the rockery up as it straddles the boundary with rocks at either side and about 8" in the middle with trees and shrubs in the middle on the boundary line. I cant see how she can move the fence without digging the lot up which I dont want. The rockery has been there since I moved in 31 years ago and was amicably maintained by myself and former neighbours. This neighbour has had a bee in her bonnet about the position of the fence for years since she realised it was about 6" to her side The fence butts up to the rocks on her side which was the only place the fencers could put it because of the rockery. It is her fence so surely it is in the right place on her land. Roughly 6 years ago my neighbour wanted to put a fence up on my boundary at the front between us. There was no fence there but there was a rockery with plants shrubs and trees which I and my previous neighbour were happy with. I initially said no, because of the rockery, but she assured me that the rockery would not be touched. So the fence went up approx 4-6" away from the boundary on her side all well and good. The problem is we have now fallen out and she is being very intimidating towards me. I am in my seventies, she is 40 something and I am feeling quite threatened. I was gardening the other day and she came out with her daughter and a tape measure and right in front of me started measuring the gap between the fence and boundary line saying quite loudly "We will have to dig it all up so we can put the fence on to the boundary line". My question is can she legally dig up my rockery and move the fence on to my boundary line without my permission.

Are you a tradesperson and able to answer this question?

Not without your permission, however legally she is within her rights to get the fence on to the legal boundary

She can put the fence on the boundary line but she can’t touch anything on your side including your rockery .... take pics now just in case .. and try your very hardest to compromise with your neighbour, you really don’t want to get into a neighbourly dispute, it will take over your life!! I’m sure she is just trying to intimidate you by measuring to provoke a reaction.... do not react, just walk away... hope this helps

After 10 years the fencing there then becomes the boundary and then there’s nothing she can do about it 👍
