Builder asking money for extra works that were never agreed

I asked a builder fixed price quote to do extension and we agreed a contract in writing. He completed a part of the extension and I paid for it. We also agreed a few extras through text messages/emails. I had to terminate his contract half way as he was not progressing well having taken many other jobs. A few months after termination he has come back and asked £50k for extra works. Never quoted for or agreed. How does the contract law work? How can builder ask for money for things not agreed?

The builder does not have the right to do this. You should not give him any extra money under any circumstances. In order for him to be able to claim extras legally, he must have a written agreement with you about the extra works required or any changed of plans and materials. If you signed an fmb,riba, jct contract with him this is a standard point written on the contract.

If works and costs were agreed in texts they stand as a contract. However, I insist on all extra works be agreed scope of works, complete costs, and a payment plan additional to your existing payment plan . All works and costs will be agreed signed and dated by both parties. Then there is no arguments to dispute. 50k is what you would expect to pay for a double extension let alone extras.

My opinion is to contact a solicitor as this is an exceptional demand. Possibly bordering on demanding money with menaces. You need a legal opinion. Do not pay any money until you have seen a solicitor. A reputable builder would not behave like this.

Any extra works should be agreed with the client, costs should be agreed and the extras added to the original price as overs and extras.
We generally agree extras via email so there is always a chain of events in the case if any disputes over costs.
