Fencing

Move fence to edge of permitted boundary (corner property, no neighbour)

Anonymous user 15/03/2024 - 2.53 PM

Hello, I live in a corner property, whose fence line is about 2-3 metres inside of the boundary line that exists on our title plan. If I want to relocate this fence to the edge of our boundary line, will I need planning permission to do this? I would intend for the new fence to be the same height as the existing one. There is no neighbour on the other side of the fence, just a pedestrian footpath, then a grass verge, and then a road. Many thanks in advance for your responses.

Are you a tradesperson and able to answer this question?

Hi l think you need to keep your fence 2.6 m away from any road and l think you are only allowed to go 1m high without planning, best to ask planning if your not sure

The finish hieght of the fence is 1.8m for the side of the garden (neighbour or no neighbour) and 1m across the front, as regards the boundary as stated in your deeds, you are entitled to re claim that area of land as you rightly own it, nobody can take that away from you, you bought that land with the house so there for your right to re claim, if your not sure, check with planning as they will have the same copy of the deeds you have, in your deeds, it will state the boundary, may inc measurements, if the Local Authority say different then you are perfectly at right to charge the L/A ground rent for that area as I said its rightly yours according to the deeds. Hope this answers your query, feel free to contact me again if you need to. I have been installing and erecting fences for 15 years. Rich

Sounds like you should be fine. If it’s your land you can put your fencing right up to the edge of your boundary. Sounds like it’s nowhere near the road with a walkway for pedestrians in between so it’s away from the road. I believe there are certain restrictions on the height at the front of the property but no so much to the sides and rear.

your have to ask high ways if you intend to remove your old fence to a new position, your allowed to build a fence 1.8 high 6ft. Cant speak for high ways, your have to ask them , if it does go outside your boundry line then your be ok.
