The housing company built on my property without permission

Hi, I am with a well known housing company and bought my house on their estate last year. Came home one day to find a small reraining wall built on my side of the fence in the garden. Apparently the neighbor has problems with flooding in his garage because of water from our garden flowing downhill. The estate is on a slope. They have stated they have the right to do this as per the contract of sale. Technially this is written there, though I would have thought they have no right to just come on my property and build an ugly wall like this? Anyone know my rights in this matter?

You would have to refer to that contract you mention. Any easements regarding access and maintenance will be detailed in there. I assume you bought it leasehold not freehold?

They could have shown some common decency and made you aware of the problem and the solution but if it’s written the contract of sale then there’s nothing wrong with what they’ve done

I will check your contract and look at the plans for the house & boundary walls they give you if you have any at all . You need some legal advice on this as I can’t let you know until seeing a contract of sale . I would think if they have built this within your Boundry they have no right of building on it but you do need to check your contract of sales !
