Anonymous user 28/02/2024 - 3.45 PM

I was having my full roof replaced, was told this would take 5-7 days but it’s still not complete after a month! There was heavy rain and it has come in my house blew the boiler and caused lots of damage but the roofer is refusing to come back and finish the job and that the damage is my fault not his because I wanted the job finished??? He’s demanding money for what he has done but where do I stand is he responsible for the damage please somebody advise me because my house needs secured 😭

Are you a tradesperson and able to answer this question?

depends really what was agreed in writing between you and the roofer, he should at the very least come and secure what has caused the water ingress, you need to keep everything in writing between you and your roofer starting by giving him a set time to get back and to start completing your job stating after the agreed start date if there is no sign of him you have the right to get someone else to Finnish it, if there is no answer then your only option may be through the courts, have you seen his public liability he may not have any, while its an insurance you hope you never need for the sake of a few hundred a year its worth every penny for peace of mind i presume there is scaffolding up, that is your next issue as most scaffolding company's can be touchy about someone other than the person the scaffolding has been hired to working on there scaffolding personally would not be parting with any money at this moment in time although legally you cannot with hold any outstanding cost he may have. incurred, i.e scaffolding, materials, building regs, citizens advice would be my first port of call along with trading standards, building control to see if he has previous, i can understand him being behind with everyone wanting him because the weather has been a bit bad lately this really does not give him the right to be jumping from job to job leaving people in vulnerable positions through no fault of there own , most customers will wait for a good tradesman we cant control the weather only work with, we personally will not start any other job till the one we are on is finished, if you got him of the site and you pressed the hired button his insurance details will be displayed to you as all new tradesmen on the site prior to 2009 have to give there liability insurance details before they could join. good luck Alex

You need to seek legal advice nobody on here can give legal advise we’re trademen not legal professionals. your entitled to 30minute free meeting with a solicitor before you have to start paying for there time, his public liability will cover the blown boiler and his is liable no questions asked unless you signed a waiver agreement stating XYZ won’t take responsibility for any water ingress whiles the re roof is on going. There has been lots of rain the last month so yes he will be hide not just on your job but everybody job his doing at the moment be polite and be patient you may feel your job is a priority bit he might have worse problems elsewhere. you should expect this to happen this time of year too, you shouldn’t expect your boiler to blown though but again this time of year you should expect a little water coming in sometimes you literally can’t weather everything with breathable membrane and tarpaulins this is a known fact. In the mean time whiles contacting solicitors for advise on the law etc you need to get a roofer to temporarily weather beside your flu pipe this is a easy job or should be providing there a lap close enough that he can go under. Id start ringing up new companies to quote to finish the work, pay the current roofer for the materials his bought and left on site if anything has to be replace or can’t be used don’t pay him for ask to see receipts to prove what was spent if you can’t claim on his liability insurance don’t give him a penny new boilers aren’t cheap.

Home owners first priority is securing the leak if the roofer refused come back you phone someone else asap your house is more important than a roofer refuses to do his job and what he's paid for. As for scaffolding company they don't care who is on there scaffolding as long as the bills paid and contacting them and updating them on the situation would be better and if they haven't been paid pay them. then you own the scaffolding then. And you can call whoever you like no time for wasting on dodgy workmen
