Does a fencer need access to neighbours garden to replace my fence?

Anonymous user 23/02/2024 - 3.27 PM

I was wondering if someone knows what are the rules in regards to changing fences. Do I need to notify neighbours that I am changing my fence in my garden? and does a fencer need access to neighbours 's land to put a fence with concrete posts/gravelboards up without having to use neighbours' garden?, I have a fence that is facing 2 neighbours and I was wondering if I can change the fence without having to ask the 2 neighbours if access is not needed to their gardens to change my fence. thank you

Are you a tradesperson and able to answer this question?

Yes you need to be on both side of need so you must ask next door for permission

Hi, I believe that if your fence is a dividing fence then there are different rules. I have just looked it up on citizens advice about this, and it says you don’t have to get permission from your neighbour to erect a fence. Further in to it though it says if it’s a dividing fence it’s a shared responsibility between the neighbours and that you can only change if it’s damaged or if there is no fence there at all. I think it depends on your personal circumstances. Try the citizens advice website, it’s very informative. All the best.

Yes you will need to access both sides, but not to fully enter the garden only a foot or two within

Simple answer No, however to keep a good relationship with fellow neighbours it’s always good to inform them of your actions ie new fence. If your not wanting to speak to them you could always write a letter and post it through there door with the date the fence is being erected. I hope this has helped with your concern and good luck with the fence I’m sure it will look fab. Kind regards Ashley @AffordableHomeImprovements

You will need access from both sides but will only work on your own side and have materials stored on your side u will just be stepping on there side for putting up the posts and it’s best to chat to your neighbor and let them know what your plans are first before work starts and not on the day that way everything will be fine

It is courtesy to ask the neighbours if your tradesperson is going to be on your neighbours property out of courtesy just reassure them that the new fence or repair will benefit them too
