Can our neighbour move our gate bolt to put up capping bricks?
Anonymous user 09/03/2024 - 3.04 PM
Our neighbour is paying to have the boundary wall, which they own, capped. I have discovered today they the builder they hired has altered the position of our rear garden gate bolt in order to fit the capping brick. It's now at an angle, and is only screwed in with 2 of the 4 original screws. He did not consult us on the matter, as we would not have agreed. Can he actually do this?? I don't feel that this is secure any more, so what are any other methods of securing our back gate?

What ever the contractor does to your property, they have to make good. My advice would be approach your neighbour as you would usually and inform them of the matter. I'm sure they'll tell the contractor to correct it.

The neighbour does have a right to maintain their property however they need to, even if it includes being on your property or having to alter something on your property, however they / a contractor should always seek written permission first. That’s a very legal way of looking at it however, and as the previous answer explained, a simple chat with the neighbour should suffice, I’m sure they’ll be happy to speak to the contractor to get it amended.

First of all, no contractor should be on your premises without permission let alone altering your property. Go see the neighbor's and tell them to get the contractor back to make good of his shoddy workmanship and if any property is damaged they are liable and must make good. Good luck getting it sorted.

Depending on your relationship with your neighbor's depends on what you can do if you get on fine I would politely ask to have catch refitted but if it's his wall and not yours I would probably ask him if it was ok to relocate your catch securly to his property first
