Fencing

Can i build a fence on both sides of my back garden

Anonymous user 23/02/2024 - 3.23 PM

I erected a fence 30 years ago which was paid for by myself and maintained it both side for 26 years. The only reason i couldn't maintain it any further is the original owner let climbing ivy, brambles and tree roots damage it. I approached her but nothing was ever done. New neighbours bought the house and decided to take wooden panels out and replace with higher ones without asking and also damaged my garden wall by trespassing and taking about 4 inches off without any discussion. All the people in our row own the fence to the right and the council have stated this to be the case. Ive been told that because the concrete post and panels belong to me i am still responsible as its still my fence. Any advise please.

Hi. It's a complicated one really. Things to consider are. Is the fence within your boundaries on your deeds. If yes then yes they have no right to remove the panels with out your permission. If it's on there boundary then I guess they probably should still have made you aware but I guess (and it is only a guess as I'm not a lawyer) they could remove them. Hope all will work out for you. hi. if the side of the fence that has had the 4 inches taken off and things have been damaged then there are a few things and routes to go down. obviously no one wants to take the small claims court so and amicable discussion between you and the neighbough to come up with some way of sorting the problem out to go halfs on the payment or something like that should work. hope this helps
