Oil tank certification

Hello all, We are attempting to buy a house and have hit a wall in relation to the Oftec certificate for oil fired central heating system. The seller serviced the boiler with an oftec engineer who said the boiler was ok but had a couple of what appeared to be advisory notices, including one about the oil tanks siting is not up to current regs. The engineer also gave an IR stating the the Oil tank was split and needed immediate replacement. The sellers now appear to have bought an oil tank online and have fitted this themselves, with no oftec or equivalent certificate. We are now wondering how they will obtain this saftey certificate from Oftec without having sited the tank as per current regs. If the sellers get an Oftec engineer to service the boiled and inspect the oil tank again and don't tell them they have recently replaced it without following the newer regs by moving it, would this come back to bite us later? We are happy to move the tank ourselves next time it needs replacing (in some years to come) but can anybody insist we move it sooner or fine us for something the previous owners did? The sellers state the fitting of replacement oil tanks in rural areas (residential home) by non self certified people happens all the time. This, obviously, isn't being accepted by our solicitors at present. Thanks for any help you can give.
