New flue over council land

We are having our existing boiler replaced and repositioned into our utility cupboard. The new flue will exit the house over a strip of grass which is owned by the council. Do we need permission from the council as the flue will not be on there land but will be just above head night attanched to our wall.
Are you a tradesperson and able to answer this question?

Anything under 2m from ground level will require a flue guard but you should also consider a flue management kit to take the plume away from that area
Other possibilities are vertical flue kit to go through the roof space this will avoid any type of vandalism to your flue

The flue will technically not be on there land just simply over looking it. Consider how many times you have walked along a public footpath and seen flue terminals exiting the gable end of properties right next to the footpath. As the previous poster has stated if flue terminated below 2 metre's then a flue basket must be fitted also good idea to fit a plume kit to minimise the nuisance of water vapour especially in the winter to passing pedestrians also may deter individuals from vandalising a very important item of equipment!
