Neighbour removed fence panels and replaced them with higher ones

Neighbour took all my wooden panels out without my consent and replaced them with higher ones. The landscape gardener who did the job has not fit them safely and you can see a gap between the panel and the post. He also fit a rock face panel which is not fitted within the grooves of the post. Landscape gardener handle grinded two inches off my garden wall without asking which has made my wall weak. If the original fence was put in by us and neighbours have replaced panels unsafely am I still responsible if it falls down because it was erected at least 6 inches on my land.

Hi If the fence is shown as your responsibility on your title deeds then the neighbour has no right to replace it without prior agreement or your consent. They could of course erect a new fence alongside it but this would have to be within their own boundary and not on your land.I would consider getting some legal advice but would definitely contact your neighbour in writing stating you are unhappy with what has been carried out and the damage done to your garden wall and make them responsible for making good and future liability as this could have consequences should either of you decide to sell your properties in the future Regards David

you are responsible for one boundary wall, and i take it its the one you have mentioned, therefore it could be seen as theft if neighbour has taken/removed your original fencing,And taken part of your land, i would speak to council first ,regarding outline of your land,and responsibilities regarding boundary. regards.

Hi that was not a good idea to do that with out consoling with you .if the panels are over 1.8 he could be breaking the law check the hight frist .if its blocking yr ligh from your garden well i hope that helps a bit cheers steve
