Stage payments of building works

Hi I hope you can help me we have a builder that has converted our loft he started in September but dropped our ceilings in August 2017 and he still has not finished we have made stage payments of 4300 in stages and now only owe 1039 but we had additional work done which cost 1500 so owe just over 2500 but there is so much wrong with it like the stairs have started coming away from the wall and all the plaster has started cracking and to be fair the works have all started falling apart and we have asked him to fix it and he has said he would but asked for more payment which we have said we don't believe we should have to pay him until works are complete as he is taking so long but he has now said he won't come back until we pay some more money I have been in tears as don't know what to do he says that because I wanted additional work I have to pay for that but it is of poor standard and not right please any advise would be good thank you

hi Stacey sorry to hear about your problems, staged payments are a good thing to have in place but in this situation where there are things not done correctly you have to withhold the last payment and be adamant that they be fixed and when he is finished have a walk round and list everything that you see as not to your satisfaction if he insists on payment seek legal advice or get in another tradesman to have a look and give you a price to repair you are within your rights to do it I wouldn't pay the last payment until you are completely satisfied regards john

Sorry to here of your problems. If you have had a good working relationship and he is still working he should put any issues right , any honest builder would and there are some customers at this stage will try it on and not suggesting you are! but communication is the key . If still cant agree get your building inspector to check it over for his opinion and to be fair get the builder to meet at same time , the legal route is the only option if all fails
