Neighbours extension terraced house party wall parapet gutter

Hi, I wondered if you would be able to provide me with some advice about the work my neighbour is proposing? We live in a middle terraced house and have a rear extension with a wall our side of the boundary, about 3 inches in from the boundary, with a flat roof and the fascia and guttering all tucked inside our boundary. The downpipe from the main roof also joins the guttering around this flat roof and it all goes to one soakaway. However, the neighbours want to build up to the boundary and then fill the gap with insulation, seal it off and put a parapet gutter on top of this wall making it a party wall. We believe this will fall below our fascia board on our flat roof as their roof is to be pitched. We are concerned with the potential damp this could cause. If we say no they made it clear they will leaving a small gap between the properties (we have a rendered wall which would then no longer be accessible for repair and maintenance). Are either of these ideas better than the other and do we have any rights to stop this from happening? Edit - I have already sought advice from the local council who are unfortunately not very helpful! Many thanks in advance.

as above seek advice from your local council , personally did a job two years ago where their was only a small gap and only after examining pictures taken down the gap could you see the neighbors out side wall was in the process of collapsing with no way on this earth short of taking both walls down internally of repairing it due to the buildings being to close together, to many councils are allowing extensions to be built without any thought for the consequences on how to carryout maintenance/ repairs. good luck alex

Hello I suggest you contact a Party Wall surveyor who will be able to agree on the party wall treatment that both you and your neighbour would be happy with. Your neighbours do have the right to build within their land but will need building regulation approval and some form of planning approval. [ unless what they are planning falls within their permitted development rights.] Before your neighbours start building their extension they should serve you the correct Party Wall notices and if you agree to the defined works they have complied under the Act. If you do not agree with their planned works then you have the right to appoint a party wall surveyor to act independently on your behalf, and they [ the neighbours ] should pay any associated fees. Hello, I suggest that you contact a party wall surveyor to act on your behalf immediately. A party wall surveyor will charge for this service but this fee is paid by your neighbour carrying out the building work. Regards Andrew
