Party Wall Act (who is responsible for writing notice)

Hello, I know that with the Party Wall Act, one is supposed to notify neighbours for example if building foundations within 3 m of their property, if lower. I also understand that if the neighbours do not write back agreeing to work within 14 days then one is officially in dispute and a party wall surveyor needs to be employed. However is it the architects responsibility to write a party wall notice on my behalf to give to the neighbours or is it my responsibility alone? I just wanted to know really. Many Thanks

Good evening. Anyone can write the Party Wall Notice, you can do this yourself, you can also act as the Party Wall Surveyor yourself but I wouldn't recommend it. Examples of Notices are available online. Just ensure all names and address of the owners are correct.

Hi there,
The client for the construction work is required to send the notification, The Principal Designer can assume the responsibility for notification of a domestic project, but only where there is written agreement between the domestic client and the Principal Designer that they will carry out the client duties.

Hi ,
It is your responsibility as the owner of the property to ensure the correct procedures are taken place , whether that is undertaken by you or you appoint the relevant person .
I would always recommend to appoint a professional especially when it comes to a Party Wall , as the ramifications to either side can be problematic and costly .
If you do consult a professional in this matter I would advise to source a local Party Wall Surveyor as they will have a better understanding of the area and other local Party Wall issues .
