Fencing

Boundary & a fence in a neighbours garden

Anonymous user 09/03/2024 - 2.55 PM

According to our title deeds the fence on our left is our responsibility. The fence is the original one from when house was built (late 60’s) & is concrete post & wire fencing. We offered the chance to our neighbours to have it replaced paying 50/50 by a reputable fencer (he’d done the other side of our garden) but they decided to replace it themselves but left the old fence on the boundary and had the new one fitted & placed within their own garden, forward several years & some dodgy repairs it needs repairing again, they then starting asking questions to friends via social media who was responsible for it but surely yes it might be our responsibility as per boundaries on deeds but they chose to replace it at their own cost and in their land please advise? Thank you

If the old fence is still in place then this will be yours and the other has nothing to do with you. If the fence erected is inside their boundary then it can't be your responsibility as it is solely on their land and is their fence. If they decide to take it down and you have removed the original fence then there may be a case for you erecting a new boundary fence but this would be a style of your choice.
