Builder says he is closing his limited business and work not completed

My builder has advised me that he cannot continue with our build and is closing his ltd business. The work has not been completed. We have a general services contract in place and have stage payments. I have heard he owes money to sub contractors and is paying them. How should i approach this?

Hi, Firstly I’m sorry to hear you are in this position. I think you would be better to approach this situation with the builder and ask him to be honest. I believe all parties would benefit from being honest and telling the truth. There are many reasons why this could be happening but without knowing any facts about the situation it’s hard to conclude the best outcome. Having said the above, I believe if you have put a legitimate contract in place and both parties have signed it on the agreement of carrying out your proposed works then the contractor should honour that agreement. Unfortunately it’s going to be difficult to give you my honest opinion in this situation without getting involved and discussing matters from both parties. I am not a legal representative but have seen this situation many times before. I think you would need to look over the contract you have made and agreed with the contractor as it/should be legally binded, Citizens advice is also worthy of a second opinion. All I can say is do not pay anymore monies until it’s resolved and ask to have a one on one meeting with the contractor away from the working environment so there’s no distractions.
