Neighbour has put up a fence

My neighbour has put a fence up out the front of the house on my boundary wall blocked 2 drains without having planning permission. I’ve been intouch with company who holds our lease as front of property is supposed to be open plan. They have checked tp1 form and he’s not allowed to put fence up they have sent him a letter to say he has 21 days to take fence down. My neighbour is refusing to take fence down so now I am been told if I want legal action to be taken do I have to pay legal costs even though I’m not the one that has broke the law

If the drain belong to the water board eg if you and your neighbours drain goes into it. It belongs to the water board and its there responsibility when required to gain access and they will remove any obstacle to gain access essential maintenance.

hi julie,
in short yes you would have to cover the legal cost but if you win you could get them back off next door i cant remember the exact term but its for covering cost i would seek legal help
